TERMS   AND   CONDITIONS

Definitions

1.1  The “Client” means the person/s, organisation or company booking the equipment, act or entertainment with the “Company”.

1.2  The “Company” means Davey Designs which is the parent company of Silly Snaps.

 

Bookings

2.1  All equipment remains the property of the company at all times.

2.2  By placing an order with us either verbally or via e-mail regardless of whether a ‘Contract of Engagement’ (COE) / Booking Form has been returned, or deposit paid, it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.

2.3  In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event, or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.

2.4 The company have the right to refuse any booking without reason.

 

Prices, Deposit & Balance Payments

3.1  All hires are subject to a £50 holding deposit, in order to secure the services of the company.

3.2  The client has 48 hours to pay the deposit in order to fully secure the requested date/s, after the COE / Booking form has been returned.  After this time, the date will be open for general sale.

3.3  Deposits are non-refundable.

3.4  The balance is to be paid in full and cleared at least 14 days prior to the event start date.

3.5  Terms for approved account clients will be strictly 30 days from invoice date unless agreed in writing by the company.

3.6  Advertised prices are subject to change without prior notification.

3.5  The company reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.  Interest will accrue on a daily basis for late payments, starting from the due date.

3.6  A commerce time fee will apply for extensive waiting periods – this will be pre-authorised with the company and invoiced accordingly. This applies to any set-up time of 1 hour or more before start time at event.

3.7 Green Screen Chroma Key Technology is charged at £25 extra to packages, excluding the 'Bargain Package'

 

Cancellations

4.1 Any cancelled order is subject to the following cancellation charges: Within 30 days of scheduled hire date there will be no refund. Outside of 30 days of scheduled hire date, the deposit will be forfeited.

 

Equipment

5.1  The Client acknowledges that it shall be responsible for any damage or loss to Silly Snaps equipment caused by any misuse of our equipment by its customers or its guests or any theft or disaster (including, but not limited, to fire or flooding) at the clients event.

5.2  Silly Snaps will require a workspace of 4m (W) x 4m (D) x 3m (H). The client will be responsible for providing suitable space as well as providing a standard working double plug socket for power to Silly Snaps equipment.

5.3  All goods remain the property of the company at all times.

5.4  The company reserve the right to amend or alter any product specifications without prior notice.

5.5 A £50 props payment will be required. This will be refunded after the event via cheque if all props are returned in suitable working order.

 

Site Location, Facilities & Conduct

6.1  Equipment will be set up in one location only as agreed on arrival and will not be moved once set up.

6.2  The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.3  The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.

 

Liability & Insurance

7.1  The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.

7.2  The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

 

Use of Images

8.1  The client gives the company permission to use images taken at their event to be used on Silly Snaps website, social media pages and for advertising and promotional purposes.

8.2  The company will not use any images that are deemed unsuitable on their website or social media.

 

Delivery and service

9.1  Delivery, set up and removal of the equipment is included in the total amount paid.

9.2  A fully trained representative of the company will be on site throughout the period booked.

9.3 All photographs will only be printed once on site (Please Note: no photographs will be printed for the 'Bargain Package'). Any further copies can be ordered after the event charged at 50 pence per photograph. This does not include the guest book copy.

9.4 All photographs will be available on Silly Snaps Facebook site one week after the event. If you or any of your guests do not want your photograph shared on the internet, a representative must be informed before the photograph is taken as all photographs will be shared on social media.

9.5 Travel expenses are free within a 30 mile radius of Sedgefield. Any further than this will be charged at 40 pence per mile. If you require a travelling distance of over 50 miles, a further fee will be agreed on date of booking.

9.6 Commerce time will be charged at £30 per hour if you require an early set up, not including up to one hour before. For example, if you require us to set up at 6pm but do not want the package to start until 9pm, you will be charged 2 hours commerce time.

 

Green Screen Chroma Key Technology

10.1 Green Screen will not work with guests wearing some shades of green and blue. This is due to the software replacing shades of green with the chosen image. It is the clients responsibility to make guests aware of this.

10.2 In the event of a green screen malfunction, images will be edited after the event. If this is not possible, an alternative back drop will be used and money for green screen refunded (if extra has been paid for Green Screen).
